Sending a takedown notice
Your notice must substantially include (§512(c)(3)):
- A signature (physical or electronic) of a person authorized to act for the copyright owner;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the infringing material and where it is located on ClientFoyer (a portal or file link is enough);
- Your contact information (address, phone, email);
- A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and
- A statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner.
On receipt of a substantially compliant notice, we will expeditiously remove or disable access to the material and take reasonable steps to notify the person who uploaded it.
Counter-notice
If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice (§512(g)(3)) to the Designated Agent including: your signature; identification of the material and where it appeared before removal; a statement under penalty of perjury of your good-faith belief that removal was a mistake or misidentification; your name, address, and phone; and your consent to the jurisdiction of the federal district court for your district (or, if you are outside the United States, the Southern District of New York) and your acceptance of service of process from the original complainant.
On receipt of a valid counter-notice we will promptly forward it to the complainant and restore the material no sooner than 10 and no later than 14 business days afterwards, unless our Designated Agent first receives notice that the complainant has filed a court action to restrain the activity.
Knowing material misrepresentations in a notice or counter-notice may create liability under §512(f).
Repeat infringers
It is our policy, in appropriate circumstances, to terminate the accounts of users who are repeat infringers of copyright, and to terminate or limit access for users about whom we receive repeated credible infringement notices. We maintain records of notices and actions taken under this policy.
Other rights
For trademark or other rights concerns, write to [email protected]. This process does not limit our right to remove content under our Terms of Service.
